European court nixes Italy embryo screening ban

(AP) ? Italy's ban on screening embryos for diseases before they are implanted in a womb violates the rights of a couple whose first child was born with cystic fibrosis, the European Court of Human Rights ruled Tuesday.

The court's finding in favor of the Italian couple triggered fresh calls among Italian politicians for a less restrictive law regulating artificial procreation.

Following fierce lobbying by pro-Vatican centrist parties, Italy's Parliament passed a law in 2004 that allows couples to use in vitro fertilization for infertility but bans pre-implantation diagnosis of embryos. Vatican teaching forbids artificial procreation methods.

The court concluded it was "inconsistent" that Italians could abort a fetus with defects but not test an embryo before implantation, as the couple had wanted to do. The couple who challenged the law before the Strasbourg court had discovered they are healthy carriers of cystic fibrosis when their daughter was born in 2006 with the inherited disorder.

When the mother became pregnant again in 2010, she had the fetus aborted when it was found to have cystic fibrosis. The couple then hoped to use medically-assisted procreation with genetic screening to avoid transmitting the disease to their children. But Italy's law forbids that, so they took their quest to the court.

The court noted that the Italian government was trying to "avoid the risk of eugenic abuses" with the law but said it interfered with the couple's "right to respect for their private and family life."

Italy has one of Europe's strictest rules for artificial procreation. It bans the donation of eggs or sperm as well as the use of surrogate mothers, and limits infertility treatment to heterosexual couples who are married or who have been living together for several years.

Italian lawmakers said it was time to change the law.

"(This ruling is the) latest confirmation of the unconstitutionality of this law, which doesn't at all protect the rights and health of citizens," said Antonio Palagiano, a lawmaker with the centrist Italy of Values party.

Similar statements came from Parliament's two largest parties, one from the center-right, the other from the center-left.

In 2009, Italy's Constitutional Court struck down one of the most contested sections of the law, which had said that only three embryos could be created at one time and that all three must be implanted.

The law was passed under conservative leader Silvio Berlusconi but even his allies urged Tuesday that it be revised.

"It's further demonstration of the fact that forcing a law, often determined through ideological reasons in one sense or another, never works," said Fabrizio Cicchitto, one of Berlusconi's closest political allies.

Unity Rally focuses on common enemy more than common beliefs

TAMPA, Fla. ? The ?Unity Rally 2012,? convening the night before the Republican National Convention began, preached a form of unity that was less about uniting around a common idea or candidate than about uniting around a common enemy: President Barack Obama.

The Sunday rally in Tampa?s River Church?featured tea party figures including two of Mitt Romney?s formal primary rivals: pizza mogul Herman Cain and Minnesota Rep. Michelle Bachmann. It was co-sponsored by?TheTeaParty.net, Cain?Solutions Revolution, the Western Representation PAC and other organizations.

Some in the crowd did not seem entirely sold on their party?s nominee. Two holdouts stood outside the event holding a Newt Gingrich sign, and several cars sported Ron Paul stickers.

Bachmann?s message was less unity-focused and more a celebration of ways in which the tea party had successfully co-opted the Republican Party.

?We are not an unwanted, second class political party,? she said in her short speech. ?We are the conscience of the United States Constitution!?

As a measure of success of the movement, she pointed to the Republican Party?s convention?platform.

?The tea party is all over that platform,? she said.

Romney?s representative at the rally, Utah Rep. Jason Chaffetz, an early endorser of the former Massachusetts Governor, devoted his speech to touting Romney?s business prowess, his personal appeal and his success rescuing the Salt Lake City Olympics. But even Chaffetz set out the stakes of November?s election in stark terms.

Chaffetz said he had spent countless hours and days campaigning for Romney??because I believe him ? I think he?s the right person at the right time ? but also because I want to defeat Barack Obama.?

Cain, who delivered the night?s keynote address, said the election was now about putting aside individual needs in favor of Republicans? common goal.

?One of the hardest things about getting out of the race because of lies and dirty politics was that I know that a lot of people supported me were gonna be disappointed,? Cain intoned. ?But let me tell you: This is why, because of the support that I had, even though I am no longer seeking the position of president, I am still on a mission to defeat Barack Obama.?

Cain does not have a speaking slot at the convention, something he said did not disappoint him.

?You see, it?s not about me,? he said to raucous applause. ?It?s about the great things we can do.?

Tropical Storm Isaac lashing Florida Keys

KEY WEST, Fla. (AP) ? Tropical Storm Isaac started pelting the Florida Keys with rain and strong winds on Sunday, and it could strengthen into a dangerous hurricane by the time it starts hitting the northern Gulf Coast in the coming days.

Exactly where Isaac would hit once it passed the Keys remained highly uncertain, with forecasters saying hurricane conditions could reach anywhere from the New Orleans metro area to the Florida Panhandle by Tuesday. And the storm is large: tropical storm conditions extend more than 200 miles from the storm's center, meaning Isaac could cause significant damage even in places where it does not pass directly overhead.

Isaac has brought havoc to the Caribbean already, killing seven people in Haiti and downing trees and power lines in Cuba. And it had officials worried enough in Tampa that they shuffled around some plans for the Republican National Convention.

However, Isaac had yet to create a panic in South Florida. In Miami Shores, some residents said they hadn't even put up storm shutters. Edwin Reeder, 65, stopped by a gas station to pick up some drinks and snacks. He didn't bother topping off his car's half-full fuel tank.

Reeder said he hadn't put up storm shutters, instead just clearing his gutters so all the water could drain. And while he didn't stock up on canned goods for himself, he did buy some extra cat and dog food for his pets.

"This isn't a storm," he said. "It's a rain storm."

On Key West, locals followed time-worn storm preparedness rituals while awaiting the storm after Isaac swamped the Caribbean and shuffled plans for the Republican National Convention. Hundreds of flights were canceled Sunday as the storm bore down.

A steady line of cars moved north Saturday along the Overseas Highway, the only road linking the Florida Keys. Residents boarded up windows, laid down sandbags and shuttered businesses ahead of the approaching storm. Even Duval Street, Key West's storied main drag, was subdued for a weekend, though not enough to stop music from playing or drinks from being poured.

"We'll just catch every place that's open," said Ted Lamarche, a 48-year-old pizzeria owner visiting Key West to celebrate his anniversary with his wife, Deanna. They walked along on Duval Street, where a smattering of people still wandered even as many storefronts were boarded up and tourists sported ponchos and yellow slickers.

"Category None!" one man shouted in a show of optimism.

The Keys were bracing storm surge of up to 4 feet, strong winds and the possibility of tornadoes. The island chain's two airports closed Saturday night, and volunteers and some residents began filing into shelters.

"This is a huge inconvenience," said Dale Shelton, a 57-year-old retiree in Key West who was staying in a shelter.

Isaac has already left a trail of suffering across the Caribbean.

At least seven people were reported dead in Haiti, including a 10-year-old girl who had a wall fall on her, according to the country's Civil Protection Office. The government also reported "considerable damage" to agriculture and homes. Nearly 8,000 people were evacuated from their houses or earthquake shelters and more than 4,000 were taken to temporary shelters.

The Grise River in Haiti overflowed north of Port-au-Prince, sending chocolate-brown water spilling through the sprawling shantytown of Cite Soleil, where many people grabbed what possessions they could and carried them on their heads, wading through waist-deep water.

After Isaac passes the Keys, it will move over the warm, open waters of the Gulf of Mexico and is expected to gain significant strength. It could ultimately make landfall on the northern Gulf Coast late Tuesday or early Wednesday. However, forecasters have stressed that the storm's exact path remains highly uncertain.

"Definitely the northern Gulf Coast should be preparing for a hurricane right now," Jessica Schauer, a meteorologist with the U.S. National Hurricane Center in Miami, told The Associated Press in a phone interview.

Isaac isn't likely to hit Tampa head-on, but it could still lash the city with rain and strong winds just as the convention ramps up. A tropical storm warning is in effect for parts of Florida's west coast, including Tampa Bay.

Convention officials said they would meet briefly on Monday, then immediately recess until Tuesday afternoon, when the storm is expected to have passed. Florida Gov. Rick Scott, a Republican, declared a state of emergency and canceled his plans to attend convention events on Sunday and Monday.

As of 8 a.m. EDT, the storm was centered about 80 miles (129 kilometers) southeast of Key West, according to the U.S. National Hurricane Center in Miami. Isaac had top sustained winds of 65 mph (100 kph).

It was moving to the west-northwest toward the Keys at 18 mph (29 kph).

Electronic cigarettes do not damage the heart, study suggests

ScienceDaily (Aug. 25, 2012) ? Smoking is the most preventable risk factor for cardiac and lung disease and is expected to cause 1 billion deaths during the 21st century. Electronic cigarettes have been marketed in recent years as a safer habit for smokers, with several millions of people already using them worldwide.

Electronic cigarettes simulate the effect of smoking by producing an inhaled vapor. The device consists of a battery, a cartridge containing liquid and a heating element which gets warm and evaporates the liquid. Laboratory analyses of the liquids show that they are less toxic than regular cigarettes. Most studies have found no nitrosamines, but even in studies where nitrosamines were found, the levels detected were 500-1400 times less than the amount present in one tobacco cigarette. This means that electronic cigarettes must be used daily for 4-12 months to get the amount of nitrosamines present in a single tobacco cigarette.

Since heart disease is the main cause of morbidity and mortality in smokers, with 40% of deaths in smokers due to coronary artery disease alone, the research team decided to perform the first clinical study of the acute effects of electronic cigarettes on cardiac function. They decided to compare their results with the acute effects of regular cigarettes on cardiac function since electronic cigarettes are marketed to smokers only, as an alternative habit.

Previous studies from the research group and several others have shown that acute smoking inhalation produces significant defects in myocardial function. This indicates that subclinical dysfunction is already present in apparently healthy asymptomatic young people who smoke tobacco cigarettes. The goal was to evaluate whether these signs of preclinical disease appear in a similar population after using electronic cigarettes.

The researchers measured myocardial function in 20 healthy young daily smokers aged 25-45 years before and after smoking one tobacco cigarette and 22 daily electronic cigarette users of similar age before and after using the device for 7 minutes.

Experienced users of electronic cigarettes were studied because they use the device more intensively than first-time users. Although both groups were of equal age, users of electronic cigarettes had a 44% higher lifetime tobacco smoking exposure compared to current smokers.

For the electronic cigarettes, a commercially available liquid with a nicotine concentration of 11mg/ml was used (NOBACCO USA Mix). This was tested by an independent toxicology laboratory and found to contain no nitrosamines or polycyclic aromatic hydrocarbons.

Myocardial function was examined using cardiac ultrasound (echocardiography) and hemodynamic measurements (blood pressure and heart rate).

The researchers found that smoking one tobacco cigarette led to significant acute myocardial dysfunction but electronic cigarettes had no acute adverse effects on cardiac function. Smoking a tobacco cigarette had important hemodynamic consequences, with significant increases in systolic and diastolic blood pressure and in heart rate. In contrast, electronic cigarettes produced only a slight elevation in diastolic blood pressure. Dr Farsalinos said: "This is an indication that although nicotine was present in the liquid used (11mg/ml), it is absorbed at a lower rate compared to regular cigarette smoking."

The echocardiography examination focused on the function of the left ventricle, the part of the heart that receives oxygenated blood from the lungs (filling or diastolic phase) and then delivers the blood to the whole body (pumping or systolic phase). The investigators found significant defects in the diastolic phase of left ventricular function after smoking one cigarette, with four echocardiographic parameters indicating worsening function. In contrast, none of the echocardiographic parameters showed any significant worsening in subjects after using the electronic cigarette. "Diastolic dysfunction is very important because it is usually the first defect that is detected before any clinically-evident cardiac disease develops," said Dr Farsalinos.

He added: "It is too early to say whether the electronic cigarette is a revolution in tobacco harm reduction but the potential is there. It is the only available product that deals with both the chemical (nicotine delivery) and psychological (inhaling and exhaling 'smoke', holding it, etc) addiction to smoking, laboratory analyses indicate that it is significantly less toxic and our study has shown no significant defects in cardiac function after acute use."

Dr Farsalinos continued: "More clinical studies need to be done before suggesting that this is a revolutionary product. However, considering the extreme hazards associated with cigarette smoking, currently available data suggest that electronic cigarettes are far less harmful and substituting tobacco with electronic cigarettes may be beneficial to health."

Best Buy founder calls on Wall Street to pressure board

NEW YORK (Reuters) - Best Buy founder Richard Schulze has reached out to some of the retailer's top shareholders and Wall Street analysts, hoping they will press the company to allow his up to $8.8 billion buyout proposal to move forward, sources familiar with the matter said.

Schulze's advisers at investment bank Credit Suisse and law firm Shearman & Sterling LLP have reached out to investors including Putnam Investment Management LLC and Fidelity Management & Research Co, the sources said. Putnam and Fidelity account for 11 percent of Best Buy.

Schulze's team has also reached out to at least half a dozen analysts who publish research about Minnesota-based Best Buy, the sources said.

The tactic comes as Schulze's team resumed negotiations with the world's largest consumer electronics chain, after talks broke down last weekend, other sources familiar with the situation said.

The company, Schulze's advisers and a representative for the former Best Buy chairman declined comment, as did the two investors.

Schulze, who owns 20.1 percent of Best Buy, needs the board's approval before he can make a formal bid. A Minnesota anti-takeover law prevents shareholders from launching a bid for a company for four years if they accumulate a stake without prior board approval. That means Schulze cannot form a buyout group with private equity firms or firm up financing for a potential bid until the board gives a go-ahead.

Moreover, sources have said private equity firms want to be able to do due diligence on the company - which is struggling against competition from rivals such as Amazon.com Inc and Wal-Mart Stores Inc - before they commit to a buyout bid along with Schulze.

At this stage, Schulze's team is pitching analysts and shareholders to put pressure on the company to at least open its books to them, so that they can put together a firm bid for the retailer.

But some of the analysts who met with Schulze's advisers were still hoping for more details of his plan. One analyst who spoke with Schulze's advisers said he was not given "any granularity on how they plan to get the deal done."

These analysts said they believed it was hard for anyone to buy Best Buy. The company hired a new CEO on Monday and the board may want to first give him time to craft a turnaround strategy.

Best Buy investors "are skeptical about a deal getting done," said Wedbush analyst Michael Pachter, who decided against taking a meeting with Schulze's advisers.

But dismal quarterly results from Best Buy earlier this week could also add credence to Schulze's argument that value is eroding by the day.

Two analysts said Schulze's original proposal of $24 to $26 a share for Best Buy could be more palatable now to investors.

Best Buy's shares closed down 3.9 percent at $17.31 on Friday.

Lance Armstrong won't fight doping charges; set to lose titles

(Reuters) - Seven-time Tour de France champion Lance Armstrong said on Thursday he would no longer fight doping charges by the U.S. Anti-Doping Agency, which said it would strip him of his titles and ban him from competitive cycling.

Armstrong, a cancer survivor long considered one of the all-time greats in his sport, made the announcement in a written statement as he faced a midnight deadline on Thursday to formally challenge the accusations against him.

"There comes a point in every man's life when he has to say, 'Enough is enough,'" the American cyclist said in the statement, which was posted on his website, Lancearmstrong.com.

"For me, that time is now. I have been dealing with claims that I cheated and had an unfair advantage in winning my seven Tours since 1999," he said.

A short time later a spokeswoman for the USADA, Annie Skinner, said the agency would strip Armstrong of his seven titles and ban him from the sport of professional cycling for life.

"It is a sad day for all of us who love sport and our athletic heroes," Travis Tygart, USADA's chief executive officer, said in a written statement released to Reuters by the agency.

"This is a heartbreaking example of how the win-at-all-costs culture of sport, if left unchecked, will overtake fair, safe and honest competition, but for clean athletes, it is a reassuring reminder that there is hope for future generations to compete on a level playing field without the use of performance-enhancing drugs," he said.

If the USADA strips Armstrong of his titles he would become one of the highest-profile athletes to face such a sanction, at least since Canadian sprinter Ben Johnson was disqualified from the 1988 Seoul Olympics after winning the gold medal in the 100m race.

The Texas-born Armstrong, who retired from professional cycling last year but remains the face of his anti-cancer charity, Livestrong, has long denied that he used performance enhancing drugs to help fuel his brilliant career.

'OUTLANDISH AND HEINOUS'

He maintained that emphatic denial in the statement issued on Thursday, stressing that there was no physical evidence to support what he called Tygart's "outlandish and heinous claims."

Armstrong, who never failed a doping test, said he would "jump at the chance" to put the allegations to rest once and for all, but refused to participate in the USADA process, which he called "one-sided and unfair."

He disputed the agency's authority to take away his titles.

"Today I will turn the page," he said. "I will no longer address this issue regardless of the circumstances."

Armstrong, 40, has been one of the most successful and controversial cyclists of all time, returning to the sport after beating cancer to win the Tour de France an unprecedented seven times in succession from 1999 to 2005.

Livestrong, known for its popular yellow bracelets, takes its inspiration from his achievements and recovery from illness.

The USADA, a quasi-governmental agency created by the U.S. Congress in 2000, formally charged Armstrong in June with doping and taking part in a conspiracy with members of his championship teams. Five other cyclists have been accused of conspiring with Armstrong over the course of 14 years to hide doping activity.

The agency said in a letter to Armstrong that it has blood samples from 2009 and 2010 that are "fully consistent" with doping.

In the letter, which was published in the Washington Post, the agency said it also has at least 10 former teammates and colleagues of Armstrong who will testify he used doping drugs during races from 1999 to 2005.

Earlier this month a federal judge dismissed Armstrong's effort to block the probe, despite a contention by his attorneys that USADA gathered evidence by threatening to ruin the careers of fellow cyclists who have agreed to testify against him.

Armstrong's lawyers also argued that the agency's rules violate his right to a fair trial and that it lacks proper jurisdiction to charge him.

In February, the Justice Department dropped an investigation centered on whether Armstrong and his teammates cheated the sponsor of their bike racing team, the U.S. Postal Service, with a secret doping program.

Armstrong's attorneys say he has "passed every drug test ever administered to him in his career - a total of 500 to 600 tests ... more drug tests than any athlete in history."

They say the International Cycling Union has proper jurisdiction in the case.
